A home daycare operator in Arvada is scheduled to appear in court on October 29 regarding a prior misdemeanor charge. This upcoming hearing occurs while Westminster police conduct a criminal investigation into the condition of an infant found in critical shape last month.

The Colorado Department of Early Childhood issued a suspension order for the facility. The order cites a previous incident in February 2026 involving a misdemeanor child abuse charge. It also notes that the owner was caring for four infants despite a license that allowed only two children.

Hannah Fuller, a parent whose two sons attended the daycare, described the events that led to the inquiry. She received a call from the operator's daughter and assistant. The caller reported in a frantic state that an infant had choked and required CPR. Fuller said she was given few details upon arrival and was told repeatedly that everything would be fine.

"My gut was like I think something worse is going on, but you don't want to think it, because then you feel guilty that you put your kids in that situation that could have been them," Fuller said. The suspension order later confirmed the child was transported to a hospital in a critical or near fatal condition.

The injured child's family has requested anonymity but allowed Fuller to share medical updates. The boy suffered a traumatic brain injury and retinal hemorrhaging. Fuller noted that the family is focusing on small improvements during a long recovery. "But they don't quite know what it will look like. They do know he will never be the same," she said.

Westminster police have not made an arrest and have not told parents their specific findings regarding the day of the incident. Officers have asked parents to take their children for physical exams to check for internal damage. A police spokesperson said investigations involving children's safety require careful review to protect privacy and integrity.

When Denver7 visited the location, a family member declined to comment and referred questions to an attorney. That attorney also declined to comment. The owner faces the October 29 court date on the earlier charge while the criminal probe continues.
